Welcome to Hirconn

Welcome to Hirconn, operated by Hirconn LLC ("we," "us," or "our"). This Terms of Use Agreement (the "Agreement") governs your access to and use of the Hirconn mobile application ("App") and related services (collectively, the "Service").

By using the Service, you agree to these Terms, our Privacy Notice, California Privacy Notice, and if applicable, our Consumer Health Data Privacy Policy for Washington and Nevada residents. Please read them carefully.

1. Eligibility

You must be at least 18 years old to use Hirconn. By using the Service, you represent and warrant that you:

Are at least 18 years old;
Can form a legally binding contract;
Are not prohibited from using the Service under any applicable law;
Have not been previously removed or banned from the Service.

2. Account Registration

You must create an account to use many features of the Service. When you do, you agree to provide accurate, complete, and truthful information, and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account with others or use another person's account.

3. Personal and Business Pages

Hirconn offers both Personal Pages (for connecting socially) and Business Pages (for promoting services to get hired). You may create and link both types of pages under your account.

By posting content to either page, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and share that content within the Service.

5. User Conduct

You agree to use the Service only for lawful purposes and in accordance with this Agreement. You may not:

Impersonate any person or entity;
Harass, threaten, or harm others;
Post or share unlawful, harmful, or inappropriate content;
Solicit others for money, services, or commercial purposes unless for services provided through your Business Page;
Use bots or automation tools without our permission.

We reserve the right to suspend or terminate your account for violating these rules.

6. Content Ownership

You own your content, but you grant us a license to use it as described in Section 3. We reserve the right to remove any content that violates this Agreement or is otherwise objectionable.

7. Termination

You may delete your account at any time or Go Incognito. We may suspend or terminate your access for violation of these Terms or for any reason, with or without notice.

8. Privacy

Our Privacy Notice describes how we collect and use your data. California residents should review our California Privacy Notice. Washington and Nevada residents should review our Consumer Health Data Privacy Notice.

9. Disclaimers

The Service is provided "as is" and "as available." We make no warranties regarding the Service, including that it will be uninterrupted, error-free, or meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Dispute Resolution

Informal Resolution: Contact us at admin@hirconn.com before initiating legal action.

Arbitration: Except where prohibited by law, disputes will be resolved through binding arbitration, not in court. You waive your right to participate in class actions.

Arbitration and Mass Arbitration

If you reside in the United States or any non-EU/UK jurisdiction, you agree to resolve disputes with Hirconn LLC through final and binding arbitration, except as otherwise provided in these Terms.

Informal Dispute Resolution

Before initiating arbitration, you agree to first contact us at admin@hirconn.com and attempt to resolve the dispute informally. Both parties will work in good faith to resolve the dispute within 60 days.

Arbitration Agreement

Any unresolved dispute will be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), using a single arbitrator. The arbitration will be conducted virtually or in the city nearest to your billing address.

You and Hirconn LLC waive the right to a jury trial.
Arbitration will be conducted on an individual basis and not in a class or representative action.

Mass Arbitration Protocols

In the event 25 or more similar arbitration claims are filed against Hirconn LLC by the same or coordinated counsel:

Parties agree to bellwether proceedings, where a limited number of representative cases are selected to proceed first.
The outcome of those cases may guide settlement or resolution discussions for the remaining cases.
Remaining claims may be paused until bellwether outcomes are reached.
The arbitrator may apply fee scheduling adjustments to account for administrative efficiency.

Opt-Out

You may opt out of the arbitration agreement by sending a written notice to admin@hirconn.com within 30 days of first accepting these Terms. Your notice must include:

Your full name
Email address associated with your account
A clear statement of your intent to opt out of arbitration

If you opt out, you will still be bound by all other provisions of these Terms.

12. Jurisdiction-Specific Rights

California: You may report complaints to the Consumer Information Division at 1625 North Market Blvd., Suite N112 Sacramento, CA 95834, or (800) 952-5210.

Washington and Nevada: Please refer to our Consumer Health Data Privacy Policy for additional disclosures.

International Users (UK and Canada)

If you are accessing or using the Hirconn App from the United Kingdom or Canada, the following terms apply in addition to those in the main Terms of Use:

UK Residents

Data Protection Rights: You have rights under the UK Data Protection Act, and the General Data Protection Regulation (GDPR), including the right to access, rectify, or erase your data. Please refer to our Privacy Notice for detailed information.
Governing Law and Jurisdiction: These Terms are governed by the laws of your country of residence. You may bring legal proceedings in the courts of your residence.
Dispute Resolution: The European Commission provides a platform for online dispute resolution, which can be accessed at http://ec.europa.eu/odr. Hirconn does not participate in dispute resolution before consumer arbitration boards.

Canadian Residents

Consumer Rights: Nothing in these Terms limits any of your rights under applicable Canadian consumer protection laws.
Language: The parties confirm their wish that these Terms, and all related documents be drawn up in English. Les parties confirment leur volonté que cette convention ainsi que tous les documents qui s'y rattachent soient rédigés en anglais.
Jurisdiction: Any disputes shall be resolved in accordance with the laws and courts of the province in which you reside.

13. Changes to These Terms

We may update this Agreement periodically. We will notify you of material changes before they take effect. Continued use after changes means you accept the revised Terms.
